General

These general terms and conditions apply to any use of the birthing rooms of Bevalcentrum EVAA.
By registering, you declare that you agree to these general terms and conditions.

 Liability

The Birth Centres provide facilities in the form of a birthing room and care surrounding the birth. The medical responsibility for the woman in labour and her (unborn) child at all times rests with the attending midwife. The management of Bevalcentrum Amsterdam is therefore not liable for any damage resulting from the actions of the midwife. The midwife has signed an agreement to this effect with the Birth Centre. The Birth Centre is not liable for loss, damage, or theft of personal belongings during the stay.

 Registration and Payment

Registration takes place upon arrival, following prior notification by the attending midwife. Where applicable, the full amount as agreed with the health insurer becomes payable from the moment of arrival.

The method of payment varies per health insurer and depends on the contract concluded with the respective insurer. In general, with a basic health insurance policy, choosing a planned outpatient birth in either a hospital or a birth centre requires payment of a personal contribution.

If the Birth Centre has a contract with the health insurer:

  • the full amount is billed by the Birth Centre to the health insurer, and any applicable personal contribution is collected by the health insurer;
    or
  • the portion of the amount covered by the basic insurance is billed by the Birth Centre to the health insurer, and the personal contribution is invoiced directly to the client by the Birth Centre.

If the Birth Centre does not have a contract with the health insurer, the client is liable for the full amount as stated under the tariffs on the website. An invoice will be sent to the client after departure.

 Place Guarantee

The Birth Centre cannot guarantee availability. If no place is available, this will be communicated to the attending midwife at the time of prior notification. The registration will then not be processed.

Additional Services and Room Service

All services available at the Birth Centre are included in the tariff.

 Short Stay and/or Transfer to Hospital

The duration of stay at the Birth Centre for the birth varies. If the stay is short, for example due to a rapid labour, the full tariff remains payable. The first two hours after birth are included in the tariff for a primary-care birth in a birth centre. The hours thereafter are maternity care hours and are offset against the total number of maternity care hours indicated for home care.

If you are referred to a hospital, the amount agreed with the health insurer is payable. If there is no contract with the health insurer, the client is liable for the full amount.

 Information on the Website

Although the information provided — which is obtained from various third parties — is considered reliable, neither the Birth Centre nor its suppliers or providers can give any guarantees regarding its timeliness, accuracy, completeness, continuity, or suitability for a particular purpose. Neither the Birth Centre nor its suppliers or providers can be held liable in any way for:

  • any inaccuracy, error, delay, or omission in (a) the information or (b) the transmission or delivery thereof; or
  • any loss or damage resulting from or caused by (a) such inaccuracy, error, delay, or omission, (b) non-performance, or (c) interruption of the information supply due to any failure or omission on the part of the Birth Centre or its suppliers/providers, or due to force majeure or any other cause beyond the control of the aforementioned parties.
  • The client expressly declares to indemnify the aforementioned parties against any claim.

Payment Conditions

Payment conditions are established by the Royal Dutch Organisation of Midwives (KNOV), statutorily established in Utrecht, and filed with the Registry of the District Court of Utrecht on 21 June 1996 under number 165/1996.

Payment Term

Payment for the care provided by the Birth Centre must be made by the client to the Birth Centre within 30 days of the invoice date, without any deduction, set-off, or discount.

Interest

In the event of exceeding the payment term, the client is deemed to be in default without prior notice of default. From the due date of the invoice, the client owes monthly interest of 1% on the outstanding amount, whereby part of a month is considered a full month.

Collection Costs

If the client remains in default of payment after a reminder, all judicial and extrajudicial collection costs incurred by the Birth Centre to obtain full payment shall be borne by the client without further notice of default. The collection costs amount to at least 15% of the claim, increased by VAT on these costs insofar as the Birth Centre cannot offset this. Collection costs include, but are not limited to, the costs of legal assistance, engaging a collection agency, bailiff, or lawyer.

Evidence

For determining the amount owed by the client, the administrative records of the Birth Centre are decisive, unless the client expressly provides evidence to the contrary.

Dispute Resolution

All disputes arising from an agreement subject to these conditions shall be submitted to the competent court of the debtor’s place of residence. If the dispute does not fall within the jurisdiction of the subdistrict court, the Birth Centre is entitled to submit the dispute to the competent court.

Safeguarding Quality of Services

One of the ways in which the Birth Centre monitors and, where necessary, improves the quality of its services is by asking those involved for their opinion on the services provided. For this purpose, the Birth Centre uses the email address of the person concerned as known to it.
